DETENTION AND DEPORTATION
Mr. Moreno has represented detained thousands of aliens in various jurisdictions throughout the United States. He is experienced in preparing bail applications for detainees and in litigating Habeas Corpus petitions to secure the freedom of detained aliens. He has also vindicated the rights of countless aliens seeking Political Asylum, Withholding of Removal and Cancellation of Removal as well as relief under the United Nations Convention Against Torture(CAT). You may be able to apply for political asylum if you have a fear of persecution on account of race, national origin ,religion, political opinion and membership in a particular social group. The term membership in a particular social group has been determined to include gays and lesbians. People who are eligible for asylum are also generally eligible for Withholding of Removal. You may be able to avoid deportation or removal from the United States if you have a fear of torture in the country of potential removal. The torture need not be based on any of the protected grounds specified in political asylum and withholding of removal.
CANCELLATION OF REMOVAL
If you have been physically present in the United States for at least 10 years, you may be eligible for Cancellation of Removal. To qualify for this form of relief, in addition to the physical presence requirement, you must show that your removal from the United States would cause hardship to US citizen or Legal Permanent Resident relatives such as children, spouses, parents, or siblings.
WHAT IF YOU ARE DETAINED BY IMMIGRATION AND CUSTOM ENFORCEMENT(ICE)?
Aliens who are detained by the US Immigration and Naturalization Service are generally eligible for bond, with some exceptions. In order to obtain bond, the alien?s lawyer needs to file or make a bond application/motion to the immigration judge. In deciding whether to grant bail, the immigration judge looks at issues such as family and community ties, flight risk, danger to persons or property and threat to the security of the United States.
FEDERAL COURT ACTIONS
If you have not been successful in obtaining relief within the Immigration system, including the Board of Immigration Appeals, you can file an action in US District courts and Us Courts of Appeals. The possible actions you may be able to file in federal courts include petitions for review, mandamus and habeas corpus petitions.
