TYPES OF CASES OUR POLICE INJURY LAWYERS HANDLE

NEW YORK POLICE OFFICER -LINE OF DUTY INJURIES

Often when police officers suffer a line of duty injury, they are able to recover much more money than the disability pay they receive. While most police officers are aware that they get their full pay and medical bills paid, while they are out on a line of duty injury, sometimes they are also able to sue for pain and suffering.

One of the most frequent questions that our NYC police officer line of duty attorneys are asked is "If a police officer gets hurt in the line of duty, can they sue?" The answer is that sometimes they can. New York’s General Municipal Law section 205(e) allows New York police officers injured in the line of duty to sue anyone who broke a law or violated a statute, which directly or indirectly caused an injury. This indirect causation standard allows a wide reach for those who violate the law and cause a police officer to become injured, either directly or as an indirect cause of the legal violation.

Police officers in New York, also have the right to sue other people or companies who are responsible for their injuries under ordinary negligence and premises liability. Our New York personal injury lawyers have represented numerous New York City police officers, as well as Westchester police officers in a variety of job related injury lawsuits.

THE GENERAL MUNICIPAL LAW

General Municipal Law 205e allows all police officers in the State of New York who are injured or killed in an accident to sue anyone who failed to comply with the requirements of any of the statutes, ordinances, rules, orders and requirements of the federal, state, county, village, town or city governments or of any and all their departments, divisions and bureaus.

SLIP ON FALL ON ICE OR SNOW

If you were on duty and were injured because you slipped and fell on ice or snow outside of a building, the building owner can be sued for your personal injures. New York City's administrative code places the responsibility to clean and clear the sidewalk in front of an apartment building or business on the property owner. Most of the Westchester towns, such as White Plains, Mount Vernon and Yonkers have similar requirements.

ICE AND SNOW CASES

Marina Police Accidents

Corrections officers, New York Police Harbor officers and several of the New York river towns have police divisions which spend a lot of time on the water and are subjected to the hazards of the sea. Under federal law, any officer who spends more than a third of his time on navigable waters including the East River, the Hudson River and the Long Island Sound, is a Jones Act seaman and can sue their employer if they are injured because of any unsafe condition on a vessel or for negligence which causes their injury.
